1. Acceptance of Terms

By downloading, installing, or using Photo Scale AI ("the app"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the app.

2. Description of Service

Photo Scale AI is an AI-powered measurement application that estimates the weight, length, or count of objects from photographs. The service:

• Requires an active internet connection
• Uses third-party AI services (OpenAI) to analyze photos
• Provides measurement estimates for weight, length, and object counting

3. AI Processing & Accuracy

• Results should not be used for commercial, medical, legal, or safety-critical decisions
• Accuracy varies based on photo quality, lighting conditions, angle, and object type
• We do not guarantee the accuracy, reliability, or completeness of any measurement
• You acknowledge that AI-based analysis has inherent limitations

4. Subscriptions & Payments

Free Tier: 3 lifetime measurement requests at no cost.

Premium: Weekly or yearly auto-renewing subscription for unlimited access.

• Payment is processed through the Apple App Store or Google Play Store
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

• Refunds are handled by Apple or Google per their respective refund policies
• No partial refunds are provided for unused portions of a subscription period

5. Fair Use Policy

To maintain service quality for all users:

• Daily usage limits may apply to prevent abuse
• Automated, scripted, or bot-based access is prohibited
• Account sharing or reselling access is prohibited
• Circumventing rate limits or security measures is prohibited

6. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, disassemble, or modify the app
• Use the service for any illegal or unauthorized purpose
• Attempt to access other users' data or accounts
• Interfere with or disrupt the operation of the service
• Use the app in a manner that could damage, disable, or impair the service

7. Device Identification

Photo Scale AI uses anonymous device identifiers for the following purposes:

• Abuse prevention and rate limiting
• Tracking free tier usage across app reinstalls
• Maintaining subscription status

Device identifiers are anonymous and cannot be used to identify you personally. They persist across app reinstalls by design and are required for use of the free tier.

8. Intellectual Property

• The app, its design, features, and content are owned by Yalçın Arslan
• You retain all rights to your photos
• Photos are not stored, collected, or reused by us in any way
• The Photo Scale AI name and logo are trademarks of Yalçın Arslan

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The service is provided "as is" and "as available" without warranty of any kind
• AI measurement estimates are not guaranteed for accuracy or fitness for any particular purpose
• We are not liable for any decisions made based on measurement results
• Our maximum aggregate liability is limited to the subscription fees you have paid in the preceding 12 months
• We are not liable for any indirect, incidental, special, or consequential damages

10. Termination

• We may suspend or terminate your access if you violate these terms
• Upon termination, your access to premium features will cease immediately
• You may stop using the app at any time by uninstalling it
• Provisions that by their nature should survive termination (including limitation of liability and intellectual property) will remain in effect

11. Changes to These Terms

We may update these Terms of Use from time to time. Changes will be posted on this page with an updated effective date. Continued use of the app after changes constitutes acceptance of the revised terms.
